MyDermAssist
MyDermAssist Terms of Use
The conditions that govern your use of the MyDermAssist app.
Effective date: 01 October 2026 · Last updated: 01 October 2026
These Terms of Use (“Terms”) govern your access to and use of MyDermAssist and related services provided by Innov-Cell Therapeutics Lda (“Innov-Cell”, “we”, “us” or “our”). Our contact details are provided in section 23.
Please read these Terms carefully before accepting them. By accepting these Terms, you agree to the conditions governing your use of the App. If you do not agree, you must not use the App.
Our Privacy Policy, available within the App and at https://mydermassist.devupgraide.com/privacy, explains how we collect, use, store and protect your personal data and how you may exercise your data protection rights.
Acceptance of these Terms is separate from, and does not constitute, consent to the processing of health-related personal data or participation in scientific research. Where required, such processing is subject to separate, explicit consent in accordance with the Privacy Policy and applicable data protection legislation.
1. About MyDermAssist
MyDermAssist is a personal routine and scar progress-tracking application designed to help users record, organise and review scar-related information over time. The App allows users to maintain scar records, upload photographs, document symptoms and product use, schedule reminders, review historical entries, view an Evolution Score and associated progress messages, and generate reports. Available functionalities may vary depending on the App version, device and geographical location.
The App presents and summarises user-provided information for personal record-keeping purposes. It does not assess wound healing, identify complications, determine treatment effectiveness or establish whether a particular product or care approach is appropriate. The App’s limitations and medical disclaimer are further described in Section 2.
2. Evolution Score and medical disclaimer
The Evolution Score is generated using predefined calculation rules applied to scar-related ratings entered by the user. It summarises changes in self-reported information over time and is not derived from photographic analysis. The score and associated messages are intended solely to support personal record-keeping and review of user-reported information.
Calculation of the Evolution Score involves automated processing and evaluation of health-related information, constituting profiling within the meaning of Article 4(4) GDPR. This processing is based on the user’s explicit consent under Section 6. Innov-Cell does not use the Evolution Score to make solely automated decisions that produce legal or similarly significant effects concerning users, as described in Article 22 GDPR. Section 7 of our Privacy Policy explains how we process personal data for this feature.
MyDermAssist is intended exclusively as a personal routine and scar progress-tracking application. It is not a medical device and is not intended to assess wound healing, identify complications, diagnose or monitor medical conditions, evaluate treatment effectiveness or provide medical recommendations. The Evolution Score and associated messages do not constitute a clinical assessment and should not be relied upon to make healthcare decisions or delay professional medical advice. Users should consult a qualified healthcare professional regarding any medical concerns or treatment decisions. We do not use the Evolution Score to make decisions that produce legal or similarly significant effects about you. Section 7 of our Privacy Policy explains how we process personal data for this feature.
3. Healthcare guidance and emergencies
MyDermAssist and its Evolution Score are not intended to guide healthcare or treatment decisions. Users should not rely on the App, its scores or associated messages to initiate, modify or discontinue care, or to delay seeking professional medical advice. A score suggesting improvement in self-reported information does not exclude the possibility of medical complications. Always follow the guidance of your healthcare professional and the applicable product instructions for use.
Users should consult a qualified healthcare professional if they experience concerns or unexpected changes in their scar or wound, including increasing pain, redness, swelling, discharge, wound separation or fever.
MyDermAssist is not an emergency medical service and does not provide emergency assistance. In the event of a medical emergency, users should contact their local emergency medical services immediately.
4. Eligibility
The App is intended exclusively for individuals aged 16 years or older, in accordance with the eligibility requirements described in our Privacy Policy. To create an account and use the App, you must meet the minimum age requirement and have the legal capacity to accept these Terms. If you are aged 16 or 17 and applicable law requires parental or legal representative authorisation, such authorisation must be obtained before using the App. Acceptance of these Terms is separate from any consent required for processing personal data, including health-related information, under applicable data protection legislation.
Individuals under the age of 16 are not permitted to register for or use MyDermAssist. If we become aware that an account has been created in breach of these eligibility requirements, we may restrict or terminate access and process or erase the associated personal data in accordance with our Privacy Policy and applicable law.
5. Your account
Certain MyDermAssist functions require the creation of a personal user account. When registering and using the App, you must provide accurate information and keep your account details reasonably up to date.
You are responsible for maintaining the confidentiality of your login credentials and taking reasonable precautions to prevent unauthorised access to your account. You must not share your account, impersonate another person or register using another individual’s identity. If you become aware of or suspect unauthorised access or misuse of your account, you should notify Innov-Cell promptly using the contact details provided in Section 23.
Innov-Cell remains responsible for implementing appropriate technical and organisational security measures and fulfilling its obligations under applicable data protection and consumer protection legislation. Your responsibilities under this Section do not exclude or limit those obligations.
6. Acceptable use
MyDermAssist is intended for lawful, personal and non-commercial use in accordance with these Terms. When using the App, you must not:
- Access or attempt to access another user’s account or personal data without authorisation.
- Circumvent security measures, interfere with the App’s technical infrastructure or attempt to gain unauthorised access to its systems.
- Introduce malicious software or engage in activities that disrupt, damage or compromise the security, availability or functionality of the App.
- Use automated tools, scripts or other means of access that interfere with the App’s normal operation or compromise its security.
- Infringe the intellectual property, privacy or other legally protected rights of Innov-Cell or third parties.
- Copy, distribute, modify or commercially exploit the App, its software or proprietary content without authorisation, except where permitted by applicable law.
Nothing in these Terms restricts activities expressly permitted under mandatory applicable law, including lawful reverse engineering, decompilation or other uses protected by statutory exceptions.
Any restriction or suspension of access resulting from a breach of these requirements will be subject to the conditions and safeguards described in Section 20.
7. Information you provide
You are responsible for the accuracy of photographs, ratings, notes, dates and other information you submit, and for having the right to provide it. Avoid unnecessary personal information. The App is intended for your own records. Do not upload information about another person, as explained in Privacy Policy section 17.
You may correct or delete your records using the available controls or exercise your rights through the privacy contact. These Terms do not transfer our data-protection responsibilities to you.
8. Photographs
Photographs uploaded through the App are stored in secure cloud storage, rather than exclusively on the user’s device, to support personal scar records, visual comparisons over time and report generation. Photographs that reveal health-related information constitute special-category personal data under Article 9 GDPR and are processed subject to the user’s explicit consent, as described in the Privacy Policy.
Photographs are not analysed or used to calculate the Evolution Score. Any use of photographs for scientific research, including photographic analysis, requires separate explicit consent, as described in Section 8 of the Privacy Policy.
Further information regarding photographic metadata removal, encryption, access controls, temporary access links, retention and deletion is provided in Sections 2.3, 18 and 19 of the Privacy Policy.
9. Reminders and notifications
Reminders are organisational tools based on your settings; they are not prescriptions or care instructions. You can disable them in App or device settings. Device permission for notifications is separate from consent to process the underlying health information.
Notifications may be delayed or missed because of device settings, network conditions or service interruptions. Do not rely on them as your sole means of following your healthcare professional’s instructions. Push messages exclude health information and scar names, as described in Privacy Policy section 9.
10. Reports and third-party information
You may create and share a PDF progress report through a channel you choose, for example with your healthcare professional. Reports are generated on our servers; their storage and deletion are explained in Privacy Policy sections 10, 18 and 19. Choose recipients carefully. Reports and educational content do not replace professional assessment.
Links to independent third-party websites are provided for convenience. Review their terms and privacy practices. We do not control those independent services; this does not remove our responsibility for providers acting on our behalf or any responsibility imposed by law.
11. Intellectual property
The App’s software, design, interface and content supplied by us are owned by or licensed to Innov-Cell. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the App for personal, non-commercial purposes. This does not transfer ownership or restrict uses protected by mandatory law.
12. Your content
You retain any intellectual property and other applicable rights in the photographs, notes and other content you submit through MyDermAssist. By submitting such content, you grant Innov-Cell a limited, non-exclusive, royalty-free licence to host, store, process, transmit and display it solely as necessary to provide the App functions you request, including maintaining personal records, displaying historical information and generating reports.
This licence does not transfer ownership of your content to Innov-Cell or authorise its use for unrelated purposes. It ends when the relevant content is deleted, subject to the limited backup and lawful retention arrangements described in the Privacy Policy. Any content retained under these arrangements may be used only for the applicable lawful purposes.
The licence granted under this Section is separate from, and does not constitute, consent to the processing of personal data under the GDPR. It does not authorise the use of your content for scientific research, advertising or other unrelated purposes. Processing health-related information requires the explicit consent described in Section 6 of the Privacy Policy, while optional scientific research requires separate consent as described in Section 16 of these Terms and Section 8 of the Privacy Policy.
Innov-Cell does not sell users’ health data or use it for targeted advertising.
13. Availability and service changes
We take reasonable steps to maintain the App, but maintenance, technical failures, security incidents or network and provider interruptions may affect availability. Using the App does not constitute professional healthcare services or replace guidance from a qualified healthcare professional.
We may change the service for valid reasons, such as security, legal compliance, compatibility or improving functionality. Changes under this section remain subject to applicable consumer law and do not impose additional charges. Where required, we give clear advance notice on a durable medium, explaining the change, its timing and your rights.
If a modification negatively affects access or use, you have the termination rights provided by applicable law. Where the statutory 30-day rule applies, the period starts on receipt of notice or implementation of the change, whichever is later, subject to the statutory exceptions. Before planned discontinuation, we give reasonable notice and a reasonable opportunity to export your records, subject to legal and security constraints.
14. Software updates
We provide software updates, including security updates, as necessary to maintain the functionality, security and conformity of MyDermAssist in accordance with applicable legislation. Users will be informed of relevant updates, their availability and any installation requirements or potential consequences of not installing them.
Users are encouraged to install notified updates within a reasonable period to maintain the App’s security, compatibility and proper functioning. Where permitted by applicable law, Innov-Cell shall not be responsible for a lack of conformity resulting exclusively from a user’s failure to install a necessary update, provided that the user was adequately informed of the update and the consequences of not installing it, and that such failure was not caused by inadequate installation instructions.
Nothing in this Section excludes or limits Innov-Cell’s statutory obligations or users’ mandatory consumer rights and remedies under applicable legislation, including relevant European Union, Portuguese and Turkish consumer protection laws.
15. App stores and charges
Apple App Store, Google Play or other distribution platforms may impose their own terms. We are responsible for MyDermAssist and our contractual duties; independent platforms are responsible for their own services.
No charge or subscription will be imposed without the required prior information and your agreement.
16. Privacy and optional research
We process personal data in accordance with our Privacy Policy and applicable data protection legislation. Processing health-related information for the App’s standard functionalities requires the user’s explicit consent, obtained separately from acceptance of these Terms.
Participation in scientific research is entirely voluntary and subject to additional, separate explicit consent. Refusing or withdrawing research consent does not affect access to the App’s standard functionalities. You may withdraw research consent at any time through Settings → Consents & Privacy → Scientific Data Use or by contacting info@innovcell.com.
Following withdrawal, Innov-Cell will cease research processing based on that consent, including further use of previously collected identifiable or pseudonymised data, and erase the associated research records without undue delay, unless a separate lawful basis and, where applicable, an appropriate condition under Article 9 GDPR justify limited retention. Previous research use or pseudonymisation alone does not justify continued retention or further research processing.
Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn. Research findings and results that have been genuinely anonymised, including aggregated results in scientific publications, may be retained. Research records are retained for a maximum of five years from collection, or until earlier withdrawal of research consent or account deletion, subject to applicable lawful retention exceptions, as described in Sections 8, 18 and 19 of the Privacy Policy. This retention period applies specifically to research data.
You may also withdraw health-data consent at any time in Settings → Consents & Privacy → Health-Data Use or contact info@innovcell.com. As the App’s core functionalities rely on the processing of this data, withdrawing your consent will result in the discontinuation of processing based on that consent, the termination of your access to the App and the deletion of your account and associated personal data. You will be clearly informed of these consequences before completing the withdrawal process, which will follow the same procedure as the “Delete My Account” functionality. Certain data may be retained where a separate lawful basis and, where applicable, an appropriate condition under Article 9 GDPR justify such retention. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.
Further details are provided in Sections 6, 18 and 19 of the Privacy Policy.
17. Consumer rights and complaints
Nothing in these Terms excludes mandatory consumer rights, including applicable rights to conformity of digital services, necessary updates, correction of defects, price reduction, termination or refunds. Depending on applicable law, certain protections may also apply where the App is provided without monetary payment.
Users may submit complaints or enquiries to Innov-Cell at info@innovcell.com. Where applicable, users may also seek assistance from competent consumer protection authorities, alternative dispute-resolution bodies or courts in accordance with the legislation and procedural requirements of their country of habitual residence. Contacting Innov-Cell does not restrict access to these mechanisms or the exercise of mandatory legal rights.
Portugal: Where applicable law requires the identification of a consumer alternative dispute resolution (ADR/RAL) entity, the Centro de Arbitragem de Conflitos de Consumo da Região de Coimbra (CACRC) (https://cacrc.pt) is identified for disputes falling within its jurisdiction. This information supplements the complaint and dispute-resolution mechanisms described above and does not restrict consumers’ access to other competent bodies or legal remedies.
18. Disclaimer of warranties
MyDermAssist is intended to support personal scar record-keeping and routine management. Innov-Cell does not guarantee any particular improvement in scar appearance, condition or outcome resulting from use of the App or any scar-care product recorded through it.
The Evolution Score, progress messages and other App outputs are based on information provided by users and do not constitute clinical assessments, confirm normal wound healing or establish the effectiveness of any product or care approach. Reminders are provided solely as organisational aids and may be delayed or not delivered due to device settings, connectivity issues or service interruptions. Users should not rely on these functions as a substitute for professional healthcare guidance.
Innov-Cell takes reasonable measures to maintain the App’s security, functionality and availability. However, occasional technical errors, interruptions or service limitations may occur. Innov-Cell remains responsible for meeting applicable legal requirements concerning the conformity, security and provision of digital services, including any mandatory obligations relating to updates and correction of defects.
Nothing in this section excludes, restricts or limits statutory guarantees, mandatory consumer rights, available legal remedies or liabilities that cannot lawfully be excluded or limited under applicable legislation. This includes, where applicable, protections established under European Union and Portuguese consumer legislation, including Directive (EU) 2019/770 and Portuguese Decree-Law No. 84/2021, as well as Turkish Consumer Protection Law No. 6502 and its implementing regulations for users in Türkiye.
19. Responsibility and liability
Our responsibility for loss arising from the App is determined under applicable law. Where the law permits, we are not responsible for loss caused solely by your unlawful misuse of the App or unrelated events outside our reasonable control. Medical disclaimers do not remove our responsibility for defects, misleading information or other failures for which we are legally responsible.
Nothing excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where liability cannot be limited, infringement of mandatory consumer or data-protection rights, or any other liability that applicable law does not permit us to exclude or limit.
20. Suspension and account deletion
You may stop using the App at any time. Stopping use or uninstalling it does not automatically delete your account or withdraw consent. You can delete your account in Settings → Consents & Privacy → Delete My Account or contact us at info@innovcell.com. Account deletion ends research participation and triggers deletion of linked personal records without undue delay, with active-system deletion within 30 days, under Privacy Policy sections 18 and 19. Lawful limited retention and backup removal follow that Policy.
If you do not use the App for 24 months, we notify you and delete your account and its data 30 days later unless you log in. This also ends research participation and follows the deletion arrangements above.
We may proportionately suspend or terminate access for a material breach, a genuine security risk, a legal requirement or service discontinuation. Where practicable and lawful, we explain the reason, give notice and an opportunity to remedy a breach, and allow retrieval of your records. Urgent security or legal restrictions may require immediate action. Suspension does not extinguish your data-protection or consumer rights.
21. Changes to these Terms
We may revise these Terms for changes to the service or applicable requirements. We notify you of material changes reasonably in advance and obtain acceptance where required. Continued use does not replace any consent required for personal-data processing or waive mandatory rights. If you do not accept a change, you may stop using the App and exercise any applicable termination or refund rights.
22. Governing law and jurisdiction
These Terms are governed by and interpreted in accordance with Portuguese law, without prejudice to any mandatory consumer protection provisions applicable in the user’s country of habitual residence.
For users habitually residing in Türkiye, this choice of law does not exclude or limit mandatory consumer rights and protections available under applicable Turkish legislation, including Law No. 6502 on Consumer Protection and Law No. 5718 on Private International Law and International Civil Procedure, where applicable.
Any dispute arising from or relating to these Terms or the use of MyDermAssist shall be subject to the jurisdiction of the courts competent under applicable law. Nothing in these Terms requires users to bring legal proceedings exclusively before Portuguese courts or restricts their right to seek legal remedies before the courts of their country of residence, where permitted by applicable law.
These provisions do not limit or exclude any mandatory rights or legal protections available to users under applicable national or European Union legislation.

24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable under applicable law, that provision shall not be binding to the extent required by law. The remaining provisions shall continue to apply insofar as they remain legally valid and enforceable without the affected provision.
Nothing in this Section permits the enforcement, modification or interpretation of an invalid or unfair contractual provision in a manner that restricts or diminishes users’ mandatory consumer rights, statutory protections or legal remedies under applicable European Union, Portuguese or Turkish legislation.
